When you place an order, you are making an offer to purchase. NKE Performance reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until NKE Performance confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as NKE Performance may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

You agree to indemnify, defend and hold harmless NKE Performance, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

You and NKE Performance consent to venue and personal jurisdiction in such courts.

COMPANY	NKE Performance.
CONTRACT	The contract for the sale and purchase of goods between the company and the customer.
CUSTOMER	The person, firm, company or authority purchasing the goods from the company.
GOODS	The supply (including any instalment of the goods or parts of them) which the company is to supply in accordance with these conditions.

Terms of payment

Orders will not be sent out until payment transactions have been cleared, and where the Customer has not paid via our payment gateway, payment must be made on or before collection, or cash on delivery.

Prices

All prices are quoted including V.A.T. NKE Performance reserves the right to vary its current price list at any time prior to notice, and goods will be invoiced to the customer at the prices ruling at the time, unless otherwise agreed by the company in writing.

Any original equipment part numbers listed or quoted are used for reference purposes only. NKE Performance reserves the right to vary its selling prices on any line or lines where the customer persistently orders in quantities not in accordance with an agreed buying term.

Delivery

We will do our utmost to dispatch items within 24 hours and you should receive your goods within 1-5 days of dispatch for most items.

We use a courier service for most of our large items. The price for post and packaging within England is based on the price of your total order, which is detailed under 'Delivery Info.'

 

Any delivery date stated is intended as an estimate only. Once products are passed onto the courier/postal company NKE Performance is not liable for any loss caused through delay or failure to deliver.

If the Customer refuses or fails to take delivery of the Goods, or fails to take any action necessary on its part for delivery or shipment of the Goods, we shall be entitled to immediately cancel the order and recover from the Customer any loss and additional cost incurred as a result of such refusal or failure, and in any event retain any payment made prior to such refusal or failure.

NKE Performance will be entitled to make delivery of orders for parts by instalments, unless the customer expresses otherwise.

Upon receipt of your order you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.

Returns

NKE Performance will not be responsible for any delivery charges on Goods being returned, where there is no fault on our part.

Goods which prove unsuitable may be returned for refund or exchange if they are returned to our head office address within 7 days of receipt. Subject to the following conditions:

- Items are received in a resalable condition and should be returned unused in their original condition in order to secure a refund.- Items are returned complete with all packaging in good condition. (We reserve the right to levy a charge to replace product packaging which is damaged or defaced).- Goods which have been specially ordered for you or manufactured for your specification, that are correctly supplied and non-defective cannot be refunded- All returns are to be sent with the invoice supplied with the order.

- Goods from discontinued lines cannot be refunded.

- Goods being returned where there is no fault on our part, will be subject to a minimum handling charge of 20% of the price invoiced.

- When Goods are returned as faulty, the Goods have to be returned to the supplier/ manufacturer before a decision can be made.

- We cannot accept responsibility for returned parcels which are undelivered, please retain your proof of postage etc, you may require it on the event of a claim with your carrier.

Exchange Items

A surcharge is levied on exchange items. The surcharge is refundable subject to the following conditions: -

a) The exchange items are returned within 10 days.

b) The exchange items are not broken, damaged or dismantled. (No charge will be applied in the event of courier/postal service fault.)
